The Information Regulator publishes a guide explaining how to use PAIA and the remedies available. It can be obtained from the Information Regulator’s PAIA guidance page.
4. Records held by Liyana
Depending on Liyana’s activities at the time of a request, records may include:
- Company incorporation, governance and statutory records.
- Financial, accounting, tax and funding records.
- Employment, contractor and team administration records.
- School, supplier, funder and partnership correspondence and agreements.
- Product, technology, security and operational records.
- Intellectual property, research and educational-content records.
- Privacy, POPIA, PAIA and compliance records.
- Pilot, monitoring, evaluation and impact records.
A listed category does not mean that every record exists or must be disclosed.
5. Records available without a formal request
Public website pages, published company information and other material expressly released by Liyana may be accessed without a PAIA request. Liyana has not published a separate notice of additional automatically available records.
6. How to request a record
- Use the prescribed private-body PAIA request form available from the Information Regulator.
- Identify the record clearly.
- Explain the right you seek to exercise or protect and why the record is required.
- Provide enough contact and identity information for the request to be processed.
- Email the completed request to jamie@liyana.org.za.
7. Fees
Any prescribed request, search, preparation, reproduction or delivery fees may apply. Liyana will notify the requester where a fee or deposit is payable before continuing, as required by PAIA and its regulations.
8. Decision and grounds for refusal
Access is not automatic. Liyana will consider the request under PAIA and may refuse access where a statutory ground applies, including protection of another person’s privacy, confidential commercial information, safety, legal privilege, research information or Liyana’s commercial interests. Written reasons will be provided where required.
9. Remedies
Liyana has no internal appeal procedure for PAIA decisions. A requester may use the remedies available under PAIA, including a complaint to the Information Regulator or an application to a court where applicable.
PAIA complaints may be sent to PAIAComplaints@inforegulator.org.za.
10. POPIA records
